DEFINITION

General terms and conditions: are all the terms and selling conditions on the website www.peltro.com (also found under the www.marinoni.peltro.com URL) applied to the business relationship between Marinoni snc and the Customer.

Marinoni snc or the Supplier or the Vendor: is the owner of the www.peltro.com website who wish to sell its products through the Internet

Products: are all the items that Marinoni snc commercializes and are part of its range

The Customer: is the buyer of the Products, intended as the final consumer, the retailer or the wholesaler who makes the purchase.

The Consumer: any natural person who is acting for purposes

which are outside his trade, business or profession

The Website: is the total of the web pages found on the Internet at the following URL addresses: www.peltro.com and www.marinoni.peltro.com

ON-LINE CONTRACT SUBJECT-MATTER 

The on-line contract is the distance-selling contract that has the purpose of the marketing and selling of the Supplier products offered on the web site and agreed with the Customer away from businesses premises.

FORMAL CONTRACT

All contracts are settled directly through the access on the website, where the Customer can place its order step by step.

All purchase orders sent to Marinoni snc have to be fulfilled in each part and should include all the information needed to identify the Customer, the ordered products and the delivery address.

By placing an order via website, the Customer makes an offer to Marinoni snc to purchase the goods detailed in the order upon the terms described in the order.

The order is accepted when Marinoni snc send a confirmation to the e-mail indicated by the Customer.

The contract between Marinoni snc and the Customer will exist once an order has been accepted.

TIME AND METHOD OF DELIVERY OF THE PRODUCTS

Marinoni snc delivers the Products ordered to the Customer through express couriers, as per the indicated freight costs.

Deliveries to Italy and EU Countries will take approximately 14 working days . For the rest of the world, delivery time can slightly vary due to the distance and to the Custom clearance.

The Marinoni snc does its best to ship the Products within 30 days from the day after the receipt of the order.

The delivery of the Products will be made after the receipt of the payment.

The invoice will be issued with the details given by the Customer when placing the order. 

PRICES

Prices are expressed in Euro and, if the order is being despatched to a destination outside the European Union (EU) do not include any local import duties on receipt of the parcel. For EU Countries only: prices include Italian sales tax (VAT) at the current rate.

All prices quoted on the Website are accurate at the time of publication. Valid prices are the ones shown on the website at the moment of the purchase. Prices are subject to change without notice.

STOCK AVAILABILITY

Marinoni aim to hold stock of all styles and sizes whilst a product is active and to ship it within 14 working days. However, if the order exceeds the available quantity, Marinoni will inform the Customer who will decide to wait and receive a single delivery based on the delivery time. The Customer will decide to allow partial shipments. 

 MARINONI snc RESPONSIBILITY

Marinoni snc will not be liable to you by reason of any delay in performing or any failure to perform any of its obligations in relation to the products ordered by you if the delay or failure was due to any cause beyond its reasonable control.

While the Marinoni snc uses reasonable endeavours to ensure that the information on this website is accurate and up to date, it does not give any warranty as to its accuracy or completeness and the Marinoni snc will not be responsible for any errors or omissions or for the results arising from the use of such information.

Marinoni snc will not be responsible for your use of any other website which you may access via links within the Marinoni website. The Marinoni snc does not control these websites and is not responsible for their content. Any such links are provided merely as a service to users of this website and their inclusion in this website does not constitute an endorsement by or affiliation with the Marinoni snc. 

YOUR RIGHT TO CANCEL

The final Consumer have the right to cancel the order within 14 days from the receipt of it and the right to receive a refund of the amount paid.

Companies or people that purchase for professional purposes other than the Final Consumer are not included.

The Consumer will inform Marinoni snc of his willing to cancel the order within 14 days from receipt to the e-mail address: info@peltro.com and return the item which must in perfect condition, unused, unwashed and with the original packaging to the following address: Via Badia 23 – 25060 Cellatica (BS) – Italy.

Marinoni will refund the amount paid within 30 days from receipt of the written request.

Parcels are returned at Consumer’s own cost. 

WARRANTY

The products are guaranteed in conformity with the Consumer’s Code (D. Lgs. N. 206/2005) that states that the Vendor shall be held liable where the lack of conformity becomes apparent by two years after delivery of the goods.

The Consumer shall lose the right if he does not report to the Vendor the lack of conformity by no later than two months after the date on which he discovered it.

In the case of a lack of conformity, the Consumer shall be entitled to have the item repaired or replaced or to have an appropriate reduction made in the price or the contract cancelled.

Please take extra care to read Product care information as we cannot accept an item returned as faulty if the appropriate care instructions have not been followed and the damage caused to the product is clearly due to wear and tear or misuse.

The Marinoni snc reserves the right to choose to replace, repair or refund the item, when one remedy is impossible or disproportionate than another.

When determining the amount of the reduction or the sum to be refunded the use of the goods is taken into account.

PAYMENT SECURITY

Payments done by credit cards or other electronic methods are done through a safe connection, which is directly connected with the Bank or on-line payments’ operator with whom Marinoni is operating.

Marinoni snc has no access to the Customer credit card’s data.

WEBSITE VIEW AND CONFORMITY OF GOODS

Marinoni snc takes every care to ensure that the description and specification of its products are correct at time of going on-line. However, specifications and descriptions of products the Website are not intended to be binding and are intended only to give a general description of the products.

The colour reproduction of the products is a close representation, anyway Marinoni snc cannot be responsible for any variation in colour caused by the browser software or computer system used to view the products.

Futhermore, Marinoni snc is not responsible if the Customer couldn’t entirely or partially view the Website on its computer. 

CHANGES TO THIS TERMS

Marinoni snc reserves the possibility to modify the regulations that regulate this General Terms and Conditions.

If changes are disadvantageous to the Customer, Marinoni snc will inform the Customer by e-mail to the latest e-mail address. In such a case, the Customer can decide to cancel the order within 15 days from receipt of the e-mail.

LAW AND TERRITORY

For any disputes arising out of the application of this Contract, the District Court in the place of domicile or residence of a consumer, if in Italy, shall have binding jurisdiction.

Marinoni snc gives no warranty that the use of its Website or the placing of any order through the Website from outside Italy complies with any applicable non-Italian laws or regulations.

COPYRIGHT AND TRADEMARK

The contents of the www.marinoni.peltro.com (or www.peltro.com) pages belongs to Marinoni snc or technology providers. The copying, distribution, reproduction or incorporation into any other work of part or all of the material available on the Website in any form is prohibited save that you may:

Print or download extracts of the material on the Website for the sole purpose of using the Website in good faith for domestic purposes or placing an order with the Marinoni snc
